This week, the Congressional Research Service published a
report on “The Terrorism Risk Insurance Act (TRIA)”. The report looks at the
creation and reauthorization of the program that is designed to backstop
insurance companies in the event of a major terrorist attack. It includes a
brief discussion about the potential coverage of ‘cyberterrorism’. It
specifically notes that:
“A cyberterrorist event, however,
must meet all other thresholds in TRIA, which might reduce TRIA’s applicability
to such cyberattacks.”
